Agreement to Terms for Australian Practitioners
By signing up or accessing the DocReport clinical services, you enter into a binding legal contract with be.smart business solutions. Please read these terms carefully.
1. Introduction & Context
be.smart business solutions ("we", "us", "our") provides the DocReport ambient AI clinical scribe, SOAP note generator, and billing compiler ("the Service") to medical clinics and healthcare practitioners in Australia. Since Australia is hosted on our premium United States cluster (`docreport.us`) to minimize clinical latency, these Terms of Service govern your use of the US infrastructure, localized for the Australian market.
2. Medical Disclaimer & Practitioner Responsibility
DocReport is an administrative clinical documentation aid powered by artificial intelligence models. The Service does not practice medicine, offer professional diagnoses, or provide independent clinical advice.
The treating healthcare practitioner remains 100% legally and clinically responsible for verifying the correctness, accuracy, and absolute clinical appropriateness of all generated documents (including SOAP notes, patient summaries, referrals) and billing recommendations (MBS procedure codes, ICD-10-AM classifications) before they are signed off, saved in a patient profile, or submitted to Medicare Australia.
3. AHPRA Recordkeeping & Clinical Standards
Australian medical practitioners are subject to strict record-keeping guidelines enforced by the Australian Health Practitioner Regulation Agency (AHPRA) and the Medical Board of Australia. You agree that DocReport is an aid for drafting clinical summaries, and it is your professional duty to ensure your medical records satisfy all professional guidelines.
4. User Account Security & Browser Local Encryption
To support data sovereignty and satisfy the Privacy Act 1988, DocReport utilizes browser-side Zero-Trust PII redaction and local practice-key encryption. You are strictly responsible for maintaining the confidentiality of your account credentials and the browser\'s secure local database containing your keys. If you clear your browser data or lose your local keys, you understand that database records encrypted with that specific key will be mathematically unrecoverable.
5. Pricing, US Stripe Billing & Currency
All transactions are routed through our secure Stripe merchant integration. B2B subscriptions are billed in Australian Dollars (AUD) recurring monthly, but processed under our United States merchant account. You represent that you have the right to charge the payment method provided.
Subscriptions (Professional: 449 AUD/mo; Ultimate: 1899 AUD/mo) can be canceled at any time directly through your billing settings panel. We provide a 30-day money-back guarantee for your first payment.
6. Australian Consumer Law (ACL) Guarantees
Our services come with statutory guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms limits, excludes, or modifies any consumer rights or statutory guarantees provided under the ACL. If the Service fails to meet an ACL consumer guarantee, you are entitled to a refund or service correction.
7. Limitation of Liability
Subject to mandatory statutory guarantees under the ACL, our liability to you for any breach of these Terms, loss, or operational damages is limited strictly to the total subscription fees paid by you to us in the three (3) months preceding the claim. We are not liable for any clinical malpractice, diagnostic errors, billing penalties, or data loss occurring due to practitioner negligence.
8. Governing Law & Jurisdiction
These terms are governed by the laws of the State of Delaware (USA). To the extent permitted by law, any disputes arising under these Terms shall be resolved in courts within the United States, subject to mandatory local statutory provisions under the ACL.
